Table 1. Top three companies (in terms of complaints) operating within the direct sales industry received by CASE from July 2014 to April 2015. Most of the complaints have been resolved by the respective businesses.

The most common nature of complaint relates to hard selling tactics and most of the sales transactions occur at the consumer’s home. CASE has also received complaints relating to unsatisfactory performance of the electrical products/vacuum cleaners purchased.

Consumer should note that where they have invited the business to their residence to perform a demonstration and/or accepted the business’s invitation to visit their residence, direct sales contract entered into by the consumer may not be covered under the Consumer Protection (Fair Trading) (Cancellation of Contracts) Regulations 2009. In which case, consumers may not be able to cancel the contract entered into within 5 days from sale.

As such, consumers are advised to exercise prudence and read the terms and conditions of such sale contract in detail as the relationship between the parties will be largely subject to the same.

Statements made by the sales personnel however will continue to be subject to the Consumer Protection (Fair Trading) Act, Chapter 52A (i.e. the sales personnel must not make commit any unfair practice as defined under the CPFTA). Consumers who wish to report any unfair practices committed can contact CASE.
